Our terms and conditions of service are as follows:

General

1. 1. Users of this Website (‘you’) acknowledge that you use this Website subject to these Terms and Conditions.
2. 2. We have made every effort to display as accurately as possible the colours of our products that appear on the site. However, as the actual colours you see will depend on your own system, we cannot guarantee that you will receive product with precisely the same colour as your monitor showed. All products have been fairly described and the weights, dimensions and capacities given are approximate only. Packaging may vary from that shown.
3. 3. As well as selling over the Internet, we sell our product through Mail Order and our Shop. Normally, prices on the internet are the same as the prices in catalogues currently being mailed, or on offer in our shop. However, prices may differ with a catalogue or a shop, because: (i) We have a Special Offer on the Internet, in a Catalogue or in a Shop; (ii) The catalogue you have may have been replaced by a more up-to-date catalogue. As a result, we cannot guarantee that all prices are the same. If you believe that you can get a better price from a catalogue, we are happy to take your order over the phone. Shop prices can only be met in the shop where the goods are offered.
4. 4. In all respects, English law governs all contracts formed between Sharpe Glass and Gifts and customers as a result of using this website. All users hereby submit to the non-exclusive jurisdiction of the English courts.
5. 5. Until a customer’s credit or debit card has been charged for the sale of our products or services, no contract will exist or apply between a customer and Sharpe Glass and Gifts. The charging of the customer’s card will be deemed our acceptance of their offer and the effective communication of our acceptance to them. This is to be interpreted and enforced with the laws of England in its entirety and will be subject to the jurisdiction of the English courts.
6. 6. All orders taken on this site are taken at: Sharpe Glass and Gifts, 22 Commercial Street, Batley, West Yorkshire WF17 5HH, UK. Your contract for supply is with: Sharpe Glass and Gifts, trading at the above location.
7. 7. Each provision of these Terms and Conditions is severable from the others, and in the event that any provision is declared invalid or unenforceable, that provision shall be amended if possible to be enforceable, but in any event, the remaining provisions shall remain in effect.

Notwithstanding anything contained in these Terms and Conditions in the event of any obligation or obligations being partly or totally impossible of performance by us for any reason beyond our reasonable control (including but not limited to war, invasion, act of foreign enemy, hostilities whether war be declared or not, civil war or strife, rebellion, acts of terrorism, strikes, lock-outs or other industrial disputes or infrastructure failure, actions, acts of God, acts of government or defaults of third parties) then such non-performance shall not be a breach of these Terms and Conditions.
9. 9. These Terms and Conditions and the Security and Privacy Policy are a complete and exclusive statement of the understanding between us and supersede all prior agreements and representations between us, relating to the subject matter of these Terms and Conditions.
10. 10. You hereby agree that the provisions of the Contracts (Rights of Third Parties) Act 1998 are expressly excluded from these Terms and Conditions so that no rights are conferred on any third parties by these Terms and Conditions.
11. 11. Disclaimer: Sharpe Glass and Gifts has taken every care in the preparation of the content of this website. To the extent permitted by applicable law, Rendezvous Protocol (RVP) disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. RVP shall not be liable to any person for any loss or damage that may arise from the use of any of the information contained in any of the materials on this web site. This disclaimer does not affect a user’s statutory rights as a consumer.
